What is Mediation?

Mediation is a form of alternative dispute resolution which means it is alternative to court. Mediation is a consensual, voluntary process facilitated by a neutral, independent mediator. Unlike a judge the mediator does not make decisions but helps facilitate discussion between the parties to assist them in reaching an agreement. 

A mediator does not give legal advice

For mediation to work you must:

  1. Be able to meet and talk through the issue with the mediator;
  2. Be willing to try and reach a solution through the mediator;
  3. Be able to listen to the other side’s position and clearly communicate your needs.

The benefits of mediation are:

  1. The parties get to reach their own agreement, instead of allowing a judge to do so;
  2. The parties can have more control over the process and the final outcome;
  3. It is faster and cheaper than going through the Court system;

Do I need a solicitor to mediate?

  1. You do not need a solicitor, but having a solicitor can be helpful;
  2. A solicitor can help decide if mediation is right for you;
  3. A solicitor can review and advise you on your settlement agreement before signing.

Is mediation right for me?

Mediation is a beneficial and cost-effective way of resolving issues without the formal requirements of court or extensive solicitor correspondence. If you are considering mediation be sure you know what you want from the mediation and that the other side can facilitate this. 

What happens if the Mediation is not successful?

OMC Mediation strives to resolve all issues that come before it; however, if mediation is not successful you can talk to a solicitor and have your case heard in court. Even if not fully successful the process will assist the parties in narrowing the dispute and the issues.
