Construction defects in Apartment Developments
This talk will provide participants with guidance and training to confront legacy construction issues facing owners’ management companies in Ireland. The talk will examine the remedies available to owners’ management companies and unit owners faced with defective construction and building safety issues within their development, and provide clear concise information on the legal remedies available, the potential liability of developers for such issues, and will examine recent caselaw of the Irish courts on this topic.

Instructor – Dr. Deirdre Ní Fhloinn is a practising barrister who specialises in residential and commercial construction disputes and advises both unit owners and owners’ management companies on all aspects of management of multi-unit developments. After practising as a solicitor in Dublin and London for over 15 years, she completed her PhD at Trinity College Dublin, on the subject of legal remedies for defective housing, and holds an MSc in Construction Law and Dispute Resolution from King’s College, London. Deirdre publishes and lectures widely on construction law.
Outcomes -
By the end of the workshop participants will:
- Understand the role of the Multi-Unit Development Act, 2011, in addressing the issue of construction defects within developments;
- Understand the legal obligations of the owners’ management company to remedy defects within the common areas of the development;
- Consider the liability of builders / developers for defects within a development and when such liability might be imposed;
- Address recent caselaw from the Courts regarding liabilities of insolvent developers and receivers.
